TERMS AND CONDITIONS OF SUPPLY OF ELECTRICITY

APPENDIX-II

Indemnity Bond to be furnished by an intending consumer for any type of service connection in any Government and/Poramboke vide clause 7(5) of the Terms and Conditions of Supply of Electricity (To be obtained in a stamped paper).

DEED OF INDEMNITY

THIS DEED OF INDEMNITY EXECUTED ON THIS THE ……… DAY OF …… ONE THOUSAND NINE HUNDRED AND NINETY ……. by Thiru. ……….. S/o …….. residing at …….. having his office/workshop at …… hereinafter called the indemnifier (which term shall mean and include executors, administrators, heirs, successors and assigns) to and in favour of the President of India, Electricity Department, Government of Pondicherry, Pondicherry hereinafter called the department (which term shall mean and include its successors in office and assigns)

WHEREAS the indemnifier has taken on lease or is otherwise lawfully occupying the premises without a lease in Door No….. situated in land/Poramboke in S.F.No., owned by …… department for the purpose of *…………. and has applied for a service connection in the above premises in his name for the purpose of *……

AND WHEREAS the indemnifier has requested the department to give a service connection in his name subject to execution of an indemnity bond by him indemnifying the department against any damage or loss caused to the department in respect of the service connection in his name. NOW THEREFORE in consideration of the acceptance of the above for a service connection in his name, the indemnifier hereby agrees to indemnify the department against all proceedings, claims, demands, costs, damages, expenses which the department may incur by reason of a fresh service connection given to the indemnifier.

The indemnifier further undertakes to make good any sum that may be found to be and become payable to the department with regard to all liabilities and claims personally as well as by means of both movable and immovable properties. The indemnifier agrees that the enhanced Security Deposit paid by him shall be adjusted against the arrears of current consumption charges but also against any claims that may arise in the event of termination of the agreement prior to the expiry of the contracted period.

The indemnifier further undertakes that the department shall be at liberty to disconnect the service connection given to him and also for loading the dues remaining unpaid by him to other service connection(s) that may stand in his name. It is further agreed by the indemnifier that all moneys due under this bond shall be recoverable as if it were arrears of land revenues.

If the indemnifier shall duly and faithfully observe and perform the above said conditions then the above written bond shall be void, otherwise the same shall remain in full force.

IN WITNESS WHEREOF Thiru ………. the indemnifier has signed this deed on the day, month and year hereinbefore first mentioned.
